1. Acceptance of Terms
By accessing or using the website at the5artsacademy.com (the “Site”) or enrolling in any program, purchasing any product, or otherwise engaging with The 5 Arts Academy (“T5AA,” “we,” “us,” “our”), you agree to these Terms of Service. If you do not agree, please do not use the Site.
2. About Us
T5AA is a Canadian-based international arts-education business offering educational content, books, comics, workbooks, online resources, courses, private instruction, workshops, camps, ensemble programs, and related opportunities across music, dance, drama, visual arts, and literary arts, serving children, teenagers, adults, families, educators, and institutions worldwide.
Selected publications from Félix Publishing House, an independently operated publishing business, may be presented or sold through the Site under separate or complementary terms noted at the point of sale.
3. Eligibility and Accounts
The Site and our programs are open to individuals of all ages, families, educators, and institutions. Where a program participant is under 16 years old, a parent or legal guardian must complete or authorize registration, enrollment, and consent to these Terms and our Privacy Policy on the participant’s behalf.
Institutional partners (schools, academies, and other organizations) should use our institutional enquiry form and confirm that the individual submitting the enquiry is authorized to represent their organization.
If you create an account, you’re responsible for keeping your login details confidential and for all activity under your account.
4. Purchases, Payments, and Refunds
We sell books, comics, workbooks, piano books, educational materials, digital resources, and program enrollments through the Site and, in some cases, through third-party platforms such as Amazon KDP or Lulu. Where a purchase is fulfilled by a third-party platform, that platform’s own terms and refund policies also apply.
Prices are listed in the currency shown at checkout and may change without notice; the price at the time of your order applies to that order.
Digital products: Because digital downloads are delivered immediately, refunds are generally not available once a digital product has been accessed or downloaded, except where required by law.
Physical products: If your order arrives damaged, defective, or incorrect, contact us within 14 days of delivery for a replacement or refund.
EU consumers: If you are a consumer in the European Union, you have a statutory right to withdraw from most online purchases within 14 days without giving a reason, except where an exception applies (for example, digital content you’ve agreed to access immediately, or a personalized item). Contact us to exercise this right.
Program enrollments: Refund and cancellation terms for courses, private instruction, workshops, camps, and ensemble programs will be specified at the time of enrollment for each program.
5. Intellectual Property
All content on the Site — including curricula, lesson materials, text, graphics, logos, and design — is owned by T5AA or its licensors and is protected by copyright and trademark law, unless otherwise noted (for example, public-domain works presented in edited or annotated form). You may not reproduce, distribute, or create derivative works from our content without our written permission, except for personal, non-commercial use of materials we’ve explicitly made available for that purpose (such as downloadable worksheets provided for classroom use).
Any reference on this Site to third-party examination boards, syllabuses, or standards (for example, Cambridge International) describes the alignment or design intent of our materials only. T5AA is an independent business; unless explicitly stated otherwise, we are not endorsed by, affiliated with, or connected to any examination board or standards body we reference.
6. Acceptable Use
You agree not to use the Site to: violate any law; infringe anyone’s intellectual property or privacy rights; upload harmful code; or interfere with the Site’s operation or other users’ experience. We may suspend or terminate access for anyone who violates these Terms.
7. Third-Party Links and Services
The Site may link to or integrate third-party services (payment processors, fulfillment partners like Amazon KDP or Lulu, email/newsletter tools, analytics). We aren’t responsible for the content, policies, or practices of third-party services; your use of them is subject to their own terms.
8. Disclaimers
Educational content, courses, and materials are provided for informational and educational purposes. While we aim for accuracy and quality, we don’t guarantee that our materials meet the requirements of any specific examination, institution, or outcome, and enrollment in our programs does not guarantee any particular result.
The Site is provided “as is” without warranties of any kind, to the fullest extent permitted by law.
9. Limitation of Liability
To the fullest extent permitted by law, T5AA is not liable for indirect, incidental, or consequential damages arising from your use of the Site or our programs. Our total liability for any claim is limited to the amount you paid us for the specific product or program giving rise to the claim.
10. Indemnification
You agree to indemnify and hold T5AA harmless from claims arising from your violation of these Terms or misuse of the Site.
11. Governing Law
These Terms are governed by the laws of Canada and the province in which The 5 Arts Academy Inc. is registered, without regard to conflict-of-law principles. This does not remove any mandatory consumer protections you’re entitled to under the law of your own country of residence.
